WowChart Per Person End User License Agreement (EULA)
Use of WowChart provided with this license constitutes your acceptance of this license.
WowChart is licensed per person, not per machine. For example, if five people use WowChart, five licenses are required.
1. LICENSE CODES Purchase of one license code allows use of WowChart by one person. One license code allows WowChart to be installed on up to 3 machines that are solely used by the licensed person. Where
multiple license codes are purchased in a single transaction they may not be
broken up into separate licenses for resale. You cannot sublicense or rent your WowChart license code or your license to use WowChart. The price of a license code is inclusive of GST (if applicable).
2. INTELLECTUAL PROPERTY You acknowledge that despite your use of WowChart, Crunchy Software Pty. Ltd. owns all intellectual property rights in and in relation to WowChart including any modifications made to WowChart. You acknowledge that you will not disable licensing controls, adapt, copy, alter, modify, reproduce, distribute, transmit, download, reverse engineer or create derivative works from WowChart, nor will you allow a third party to do so.
3. WARRANTY To the extent permitted by law: (a) Crunchy Software Pty. Ltd. does not warrant that the functions contained in WowChart will meet your requirements, or that the operation of WowChart will be uninterrupted or error-free, or that defects in WowChart will be corrected; (b) Crunchy Software Pty. Ltd. Does not warrant or make any representations regarding the use or the results of the use of WowChart or any documentation provided to you in terms of their correctness, accuracy, reliability, or otherwise; (c) WowChart is provided to you ''as is.'' To the extent permitted by law, We make no warranties, either express or implied, with respect to WowChart and/or associated materials provided to you, including but not limited to any warranty of merchantability, fitness for a particular purpose or against infringement; and (d) No oral or written information or advice given by Crunchy Software Pty. Ltd. or our authorized representatives shall create a warranty or in any way increase the scope of this warranty.
4. LIMITATION OF LIABILITY Your exclusive remedy under the above limited warranty shall be a full refund of the purchase price. To the extent permitted by law, Crunchy Software Pty. Ltd and our authorized representatives and distributors are not liable to you for any claims or damages whatsoever in relation to your use of WowChart, including property damage, personal injury, intellectual property infringement, security breaches, loss of profits, or interruption of business, or for any special, consequential or incidental damages, however caused, whether arising out of breach of warranty, contract, tort (including negligence), strict liability, or otherwise.

DISTRIBUTION
6. TERMINATION If you fail to comply with the terms and conditions of this license, this license to use WowChart is terminated. Upon such termination you agree to immediately uninstall and cease using WowChart.
7. CONFIDENTIALITY Each Party will not disclose the Confidential Information of the other Party without the prior written consent of the other Party. Each Party will take all reasonable steps to ensure that its employees and agents, and any sub-contractors it engages do not make public or disclose the other Party's Confidential Information. A Party will not be in breach of this clause in circumstances where it is legally compelled to disclose the Confidential Information. This clause shall survive termination of this license.
